Ian Barkley Coles was indicted last month on three counts which charge the following:

Count 1

On or about July 8, Coles did knowingly possess in and affecting commerce, a
firearm, in violation of United States Code.

Count 2

On or about the same date as in Count 1, he, in connection with the acquisition of a firearm and in connection with the attempted acquisition of a firearm, from a federally licensed firearms dealer in Roanoke Rapids, did knowingly aid and abet another who made false and fictitious oral and written statements.
Those written statements on United States Department of Justice, Bureau of Alcohol, Tobacco and Firearms Form 4473 were intended and likely to deceive the pawn shop in respect to a fact material to the lawfulness of the sale and disposition of said firearm to the defendant.

Count 3

On or about the same date in the previous counts, Coles knowingly did aid and abet another in making a false statement and representation to the pawn shop.

Detention order

On Monday, Coles was ordered to remain in federal custody and his arraignment date was set for the February 13 term of court in Wilmington before Senior Judge James C. Fox. A pretrial conference is set for January 4 and motions are due by February 6.
In denying Coles pretrial release several factors were noted, court records show.
The first was that “by clear and convincing evidence that no condition or combination of conditions of release will reasonably assure the safety of any other person and the community.”
The court noted the weight of the evidence against Coles is strong and he will be subject to a lengthy period of incarceration if convicted.
His previous criminal history, history of alcohol or substance abuse and lack of stable residence played a part as did his lack of significant community or family ties in the Eastern District of North Carolina.
Court documents also note his prior violations of probation, parole or supervised release and that no third party custodian was presented to the court.
Coles was arrested in Hopewell, Virginia, on December 8 after a federal warrant for his arrest was issued early last month.
Roanoke Rapids Police Chief Chuck Hasty said when ATF agents approached Coles in Hopewell, he ran, and a struggle ensued to take him into custody. ATF agents also discovered Coles was in possession of another handgun following his arrest.
Hasty said RRPD Investigator Chris Babb and the ATF investigated the pawn shop case which led to the federal indictments.
In May of 2012 Coles pled guilty in the assault of two women at a Roanoke Avenue business.
In 2010 he allegedly entered F and F Rentals through the back door and attempted to rob the store’s two female employees. He used pepper spray on them and struck a then 67-year-old female employee in the head with the shotgun he carried inside the business.
