The Halifax County Sheriff’s Office has met with the District Attorney’s office and it appears no charges will be filed against a man who shot and killed an intruder Friday morning.

Lt. Bobby Martin said this morning Marcell Alston continues to recover from the wounds he received after he was shot by 61-year-old Carlton Burgess of Lumberton, N.J. Alston was getting his gun when he was shot.

In an interview with WRAL, Carolyn Burgess, the widow of Mr. Burgess, said, “I’m hurt. It didn’t have to happen.”

Mrs. Burgess said her husband believed she was having an affair with Alston, an old school friend. “He assumed it was an affair,” she told the TV station. “He became almost violent. That’s all he thought about.”

Mrs. Burgess told WRAL, “I pray God gave him enough breath to ask for forgiveness.”

Martin said both men used revolvers to shoot one another.

Burgess held the domestic grudge with Alston since 1988 and the issues serve as an apparent motive in the attack, the sheriff’s office Friday, the day law enforcement responded to 911 calls from a residence in the 5000 block of Highway 301 in Halifax.

A resident reported that a man knocked on his door and attacked the resident when the door was opened. The suspect assaulted the victim, striking the victim in the head. At some point during the attack, the suspect shot the victim in the lower back area.

The victim managed to get to his own firearm and shot the suspect in the upper torso. The suspect was deceased upon deputies' arrival. The victim was taken to Halifax Regional Medical Center.
