After a June arraignment passed, one scheduled for next month in the case of a former Warrenton police officer charged with three federal counts of excessive force is now scheduled for November, according to court records.

Mark Aaron Oakley, who also worked as an officer for Littleton and Roanoke Rapids, remains on pretrial release and is scheduled for arraignment on November 12.

Oakley’s federal public defender noted in the motion seeking an extension additional time is needed “to review the voluminous discovery material with Mr. Oakley, conduct any necessary investigation, assess whether any motions are warranted in this case, and determine the appropriate resolution of this case.”

G. Alan Dubois, Oakley’s public defender, wrote in the motion that discovery consists of nearly 7,000 pages “and what conservatively appears to be in excess of 100 video files. Moreover, it is under a partial protection agreement such that Mr. Oakley may view significant portions of the discovery only in the presence of his attorney and legal team.”

Oakley was federally charged in April with three counts of use of unreasonable force when he deployed his Taser while acting under color of law

In one of the cases referenced in the indictment he used his Taser in stun-drive mode which means the wire probes were not deployed. In the other two cases he used his Taser in probe-stun mode which means the wire probes were deployed.

The three offenses resulted in physical injury to the victims, according to the indictment.
