A woman suing the city of Roanoke Rapids and others federally over the demise of her business was charged on June 17 with two counts of misdemeanor larceny, according to eCourts records.

Warrants filed by the Apex Police Department show that Vivian Pompliano, 62, of Cary was charged with the following:

Count 1 — Unlawfully and willfully taking away from Kirklands a mirror and lamp valued at $609.98

Count 2 — Unlawfully and willfully taking away from TJ Maxx cups, home decor items, blankets, pictures, and a faux plant valued at $452.74

Her $1,000 secured bond was posted by Bigg Ants Bailbonds of Raleigh on June 18, according to eCourts records.

She has a July 29 district court appearance in Wake County.

As of this report there have been no further filings in her federal lawsuit since May 29

That’s when United States Magistrate Judge Kimberly A. Swank entered an order that allows for an extension of time filed on behalf of Pompliano, the owner of the former Pomp Boys Motors in Roanoke Rapids.

Lloyd C. Smith III, an attorney at the Windsor-based Pritchett & Burch law firm representing Pompliano, had entered an earlier motion seeking time to respond to Rose Beacham and L&R Motor Company’s first set of interrogatories. 

It also requested production of documents and admissions to the plaintiff or otherwise plead by Saturday.

Beacham and L&R are defendants in the lawsuit filed by Pompliano that charges harassment and false criminal charges by the Roanoke Rapids Police Department as well as the actions of others, led to the demise of her business.

The city of Roanoke Rapids; former officer Jamie Lee Hardy, and officers Antonio Seward, and Jayme Shelburne in their individual and official capacities; Beacham in her individual capacity; and L&R Motor Company remain defendants in the lawsuit after a voluntary dismissal was filed on behalf of defendants Vickie Evans and Dennis Harvey in January.

At the heart of L&R Motors-Beacham response is a 1969 Ford Galaxie that Beacham, who was more than 80 in April of 2021, arranged to be driven to Pomp Boys for repair estimates.
