Federal court records show that a man charged locally last week with 10 counts of third-degree exploitation of a minor had issues abiding by the terms of his supervised release after serving his time in June of 2020.

Jeffery Bryan Carter had been sentenced in June of 2013 after he entered a guilty plea to receiving and distributing child pornography, according to an order entered into the federal court system in August of last year. That charge stems from an investigation by the Cabarrus County Sheriff’s Office. 

On January 27, 2022, his supervision was revoked, and he was given a term of imprisonment of one day. Additionally, it was ordered by the court that the defendant be placed on supervised release for the remainder of the previously imposed term and he was ordered to complete nine months of home detention.

On July 26, 2022, the defendant's supervision was revoked, and he was given a term of imprisonment of seven days. It was further ordered by the court that the defendant be placed on a term of supervised release for the remainder of the previously imposed term. In addition, the defendant was ordered to complete a three-month term of home detention.

From evidence presented at the revocation hearing on August 19, 2024, Carter violated the terms and conditions of the judgment as follows:

Failure to report for polygraph examinations as directed by the probation office.

Using a controlled substance.

Failure to participate as directed by the probation officer in sex offender treatment.

Chief United States District Judge Richard E. Myers II committed Carter to the custody of the Bureau of Prisons for a period of six months.

Update on local charges

Meanwhile, an arrest warrant details the graphic files seized that led to Carter being charged with 10 counts of third-degree sexual exploitation of a minor.

The arrest warrant shows that all the files seized involve prepubescent males and females engaging in sexual activity or posing provocatively.

One of the images features a nude child in a bucket in the company of an adult while another image features nine juveniles between the ages of 2 to 6 performing sexual activity, according to the warrant filed by Detective C. Watkins of the Halifax County Sheriff’s Office.

On Tuesday Carter, 35, appeared before District Court Judge Jamal Summey where he signed an affidavit of indigency and was assigned a public defender.

His bond was set at $25,000 secured but as of this report he remains in the Halifax County Detention Center.

A disposition hearing is set for May 22, according to records filed in the eCourts system.

The sheriff’s office said Friday the first search warrant was executed on April 9 by deputies, investigators and agents of the Halifax Regional Drug and Gang Task Force at an address where files had been uploaded.

Multiple devices were seized and Carter was also arrested for failure to register as a sex offender.

Most of the evidence has been processed and additional warrants were obtained by Watkins. Those warrants were obtained on Friday for 10 counts of third-degree sexual exploitation of a minor.

As of this report the search warrants had not been filed in the eCourts system.

Cabarrus County case

Federal court records show that around November 6, 2012, to November 27 of that year, Carter, who was in Cabarrus County at the time knowingly received and distributed child pornography.

On November 6, 2012, the Cabarrus County Sheriff’s Office identified an internet protocol address sharing files bearing digital signatures matching those of previously identified child pornography files. 

A computer user at that IP address was using the Ares peer-to-peer file sharing network, and sharing three child pornography files at that time. 

Between November 7, 2012, and November 9, 2012, the sheriff’s office directly connected to the computer at the subject IP address and downloaded a total of six video files containing child pornography. One of those videos had a running length of 16 minutes and 6 seconds.
