Belfield subject to enhanced penalties in federal case

Michael Rakim Belfield could receive enhanced penalties pending a review of his prior convictions, federal court records show.

Those factors moved his arraignment on a three-count cocaine and heroin indictment to the May term of court.
His arraignment was originally scheduled for last week and he remains in federal custody at the Brunswick County Jail.
Belfield’s federal public defender noted in a motion seeking continuance while it is believed the case will be resolved without trial, “Mr. Belfield has multiple prior convictions which may or may not subject him to enhanced penalties both under the guidelines and under the statutes.

“Counsel needs additional time to collect the necessary records in order to fully ascertain which of Mr. Belfield’s prior convictions, if any, are predicate offenses. Only once this necessary research has been completed can counsel adequately advise Mr. Belfield as to his potential exposure at sentencing.”
Belfield was indicted in December. The indictment stemmed from his arrest in April of 2015 following a raid on Dickens Avenue in which City County Drug Task Force agents seized 36 bindles of heroin.
