Mitchell gets 10 years

United States Attorney Thomas G. Walker announced that in federal court Monday Senior United State District Judge Malcolm J. Howard sentenced Damien Edward “Dang-Dang” Mitchell to 10 years in prison.

Mitchell, 28, will also receive five years supervised release and must by $1,550 in restitution.

A Federal Grand Jury returned a Criminal Indictment on January 13, 2011. On May 6, 2011, Mitchell of Roanoke Rapids pled guilty to distributing 28 grams or more of crack cocaine base.

According to the investigation, on September 20, 2010, law enforcement received information Mitchell was selling crack cocaine from his residence in Roanoke Rapid, North Carolina.

Subsequently, two controlled purchases were arranged on September 21, 2010, and September 28, 2010, in which 12.9 grams and 32.6 grams, respectively, of crack cocaine were purchased.

Further investigation revealed that he had been selling since 2005 and was responsible for selling 339.6 grams of crack and 141.75 grams of powdered cocaine since that time.

The Bureau of Alcohol, Tobacco, Firearms and Explosives and the Halifax County Sheriff’s Office conducted investigation of this case.

Special Assistant United States Attorney Glenn Perry was the assigned Prosecutor. Mr. Perry is a prosecutor with the Pitt County District Attorney’s Office. District Attorney Clark Everett has assigned him to the United States Attorney’s Office to prosecute federal Organized Crime Drug Enforcement Task Force criminal matters. This has been made possible by a grant funded by the Governor’s Crime Commission.
