“After consultation with the District Attorney's Office, the case will not be pursued further,” Major Bruce Temple said in a news release. “We also express sympathy for the victim and survivors of the deceased, who have relatives in Halifax County and New Jersey. The victim is expected to be released from the hospital this week, after this tragic event.”
Carlton Burgess, 61, of Lumberton, N.J., held a domestic grudge with Marcell Alston since 1988 and the issues serve as a motive in the attack.
Law enforcement Friday responded to 911 calls from a residence in the 5000 block of Highway 301 in Halifax.
A resident reported that Burgess knocked on Alston’s door and attacked the resident when the door was opened. Burgess assaulted the victim, striking him in the head. At some point during the attack, Burgess shot Alston in the lower back area.
Alston managed to get to his own firearm and shot Burgess in the upper torso. Burgess was deceased upon deputies' arrival
