Documents filed in the federal court system show Hockaday faces one count of conspiracy to distribute and possess with the intent to distribute 28 grams of crack cocaine and two counts of distribution of crack cocaine.
Hockaday was taken into custody Tuesday after Roanoke Rapids Police Officer Terrence Tyler stopped him for driving while license revoked, according to Captain Andy Jackson.
Because Hockaday had a fugitive warrant on him, he was taken into federal custody, Jackson said.
Major Bruce Temple of the Halifax County Sheriff's Office said Hockaday's arrest is part of Operation Burnout, but declined to elaborate.
According to the true bill of indictment filed on August 10, it is alleged that from 2005 to March 14 of this year, Hockday, “Did knowingly and intentionally combine, conspire, confederate, agree and have a tacit understanding with others known and unknown to the grand jury, to distribute and possess with the intent to distribute 28 grams or more of cocaine base and a quantity of cocaine.”
The indictment also shows that on February 10, Hockaday allegedly distributed crack as was allegedly done again on March 14.
The indictment notes that Hockaday allegedly committed these crimes after two prior drug convictions had become final.
In a forfeiture notice contained in the indictment it notes that Hockaday must forfeit any property which was bought with drug money. That also applies to any items that may have been sold.
Motions for discovery were filed in the case Tuesday by Hockaday's attorney, James Perry of Kinston.
